NAAU Committee Meeting in Kyiv: Pylyp Orlyk Foundation’s Bill on AI in Justice and the use of foreign case law in Ukraine
On April 10, 2026, a joint session of the Committee on Legislative Initiatives in the Field of Advocacy and the Committee on Digitalization of Advocacy of the National Bar Association of Ukraine (NBAU) was held. The session reviewed a draft law prepared by Pylyp Orlyk Foundation specialists on the introduction of artificial intelligence systems into the justice process and the application of foreign judicial practice in Ukrainian courts. Foundation representatives took part in the meeting.

What Was Discussed at the Session
Participants discussed two key areas of the draft law. The first concerns the introduction of AI systems into court proceedings — in particular, delegating to AI the preparation of standard procedural rulings and draft court decisions. The second area provides a mechanism for mutual recognition and enforcement of court judgments, which would open the way for applying foreign judicial practice in Ukrainian courts.
The Pylyp Orlyk Foundation was represented at the session by Maksym Baryshnikov — Head of International Legal Projects, Oleh Zaiarny — Scientific Advisor to the Foundation, and Oleksiy Yushchenko — Head of Legislative Activity.
Participants’ Positions
Members of the relevant NBAU committees acknowledged the timeliness of the proposed changes. At the same time, the discussion identified key risks that require legislative and technological consideration.
In particular, participants emphasized the need for a clear delineation of the scope of foreign jurisdiction: referral of cases to foreign courts should apply exclusively to large commercial disputes, while labor, family, and consumer matters must remain within Ukrainian jurisdiction. Regarding the automation of judicial processes — responsibility for the final decision must always rest with a human, and decisions of foreign jurisdictions should take effect only after verification of their compliance with Ukrainian public order and national interests.

The comments provided by session participants will be processed by Foundation specialists in the near future. Following revision, the draft law is planned to be submitted to the relevant authorities for further consideration in the legislative process.
